Punitive damages award for a mesothelioma lawsuit in New York

The Erie Country Court jury concluded that Fisher Control Internationals bares some blame for the death of Ronald Drabczyc. His death was caused by mesothelioma cancer. Drabczyc has worked in the past for the Hooker Chemical in Buffalo, New York, as a repair man. His job was to control valves manufactured by Fisher, valves that contained asbestos.

His family intended lawsuit against Fisher Control International.

The Court jury has awarded $ 2.25 million, including an impressionant amount of $ 750,000 as punitive damages.

Because Fisher fail in warning the workers about the asbestos exposure, the risk and the fatal disease they can develop by working with those valves containing asbestos, he paid $ 1.5 million in compensatory damages for the dead repair man’s family, Ronald Dabczyc. He also paid additional $ 750,000 punitive damages. This was a strange situation, because usually in asbestos mesothelioma lawsuits punitive damages are rare. This might be the first case in 20 years, award in New York.

Dabczyc worked as a repair man at Hooker from 1970 to 1988 and died in 2005, November 29 because he developed mesothelioma cancer after exposing himself to asbestos fibers.

He developed malignant mesothelioma cancer because he was exposed to asbestos without knowing the exact risk of the exposure. Mesothelioma is known as a rare type of cancer that affects the body internal organs. It starts with the lining of the pleura and continues with the heart and abdominal area and the rest of body’s organs. Inhaling or swallowing the asbestos fibers it can be fatal. Symptoms can show after 10 out to 40 years and it is almost often discovered in an advance stage which makes it very hard to treat it.
